Terms of Use (Massage Services)

These terms of use (hereinafter referred to as the "terms") stipulate the conditions for the use of massage services provided by Niseko Dream Co., Ltd. (hereinafter referred to as the "company") and are agreed upon by all users (hereinafter referred to as "users") who utilize the services under these conditions and consent to these terms.

Article 1 (Purpose)

  1. The massage services provided by the company are intended for relaxation purposes.

  2. Therapists dispatched by the company to users do not engage in medical or therapeutic practices requiring national qualifications (such as anma massage, acupuncture, moxibustion, or judo therapy) or activities aimed at adult or rejuvenation services.

Article 2 (Application)

  1. These terms shall apply to all relationships related to the use of the services between users and the company.

  2. Users shall use the services at their own discretion and responsibility, and all responsibilities related to the use shall be borne by the users.

Article 3 (Conditions of Use)

The conditions of use of the services shall be as follows:

  1. Business hours and holidays shall be specified separately. However, in the event of temporary closure due to various circumstances, notification shall be made through the company's website and social media channels.

  2. The eligible age for using the services shall be 5 years old or older.

  3. Additional precautions for using the services shall be specified separately, and users may be refused service if there is a risk that the services cannot be safely utilized.

Article 4 (Method of Use)

  1. Users must make reservations for using the services in accordance with the precautions specified by the company. However, depending on the operational status and congestion of the services (including the company's app), reservations may not be accepted.

  2. Even if the start time of the service is delayed due to reasons on the user's end, the company shall not extend the service time or reduce the usage fee.

  3. In the event that the start time of the service may be delayed due to natural disasters, accidents involving transportation or communication lines, or other force majeure events, the company or the therapist shall contact the user through the company's designated method. However, if providing the services becomes difficult due to these circumstances, it shall be handled as specified in Article 11, paragraph 1, item 2.

Article 5 (Usage Fee)

  1. The usage fee for the services shall be as separately specified by the company.

  2. Users shall pay the usage fee corresponding to their desired course before the start of the treatment.

  3. The company shall not refund any portion or the entirety of the usage fee to the user for any reason.

Article 6 (Cancellation)

  1. If a user cancels within 24 hours of the reserved date and time, the user shall pay the full usage fee as a cancellation fee. However, if the usage fee has already been paid, the entire amount shall be credited towards the cancellation fee, and no refund shall be provided by the company.

Article 7 (Prohibited Acts)

  1. Users shall not engage in the following acts:
    (1) Acts that violate laws, ordinances, regulations, these terms, or public order and morals.
    (2) Requesting medical practices or other activities requiring national qualifications or activities that may fall under such categories.
    (3) Requesting adult services or rejuvenation activities from therapists.
    (4) Requesting treatments that deviate from the treatment content specified by the company.
    (5) Engaging in sexual, lewd, or violent behavior, bodily contact with therapists, or any behavior that may endanger or cause discomfort to therapists.
    (6) Violence, threats, coercion, intimidation, defamation, slander, or other acts that may damage the reputation or physical well-being of therapists.
    (7) Acts that obstruct or may obstruct the company's business operations.
    (8) Requesting services while dressed inappropriately.
    (9) Directly requesting treatment from therapists or engaging in poaching activities.
    (10) Engaging in behavior that damages the honor or credibility of the company or therapists.
    (11) Any other acts deemed inappropriate by the company or therapists based on reasonable grounds.

  2. If the company determines that a user has violated the provisions of the preceding paragraph, the company may interrupt the treatment. In such cases, the user shall still be required to pay the full usage fee, and no refund shall be provided by the company.

  3. The company shall not be liable for any damages incurred by the user or third parties as a result of measures taken by the company under this article.

Article 8 (Intellectual Property Rights)

  1. Copyrights, trademark rights, and other intellectual property rights related to individual information, trademarks, images, advertisements, designs, videos, and data provided by the company in the services belong to the company or the copyright holder.

  2. Users shall not replicate, edit, publish, broadcast, distribute, sell, provide, translate, or otherwise use such information, trademarks, images, advertisements, designs, videos, and data.

Article 9 (Handling of Personal Information)

  1. The company shall handle the personal information of users (including all or part of the membership information) and other information related to the use of the services appropriately based on the company's separately defined privacy policy.

  2. Before using the services, users shall review the company's privacy policy and consent to the handling of their personal information by the company.

  3. The company may utilize and disclose the information, data, etc., provided by users to the company in an unidentifiable form as statistical information at the discretion of the company, and users shall not object to this.

Article 10 (Disclaimer)

The company does not guarantee that the services meet the specific purposes of users, expect functions, value, accuracy, usefulness, continuous availability, and absence of defects or malfunctions in the services, regardless of whether such guarantees are made explicitly or implicitly.

Article 11 (Assignment of Position under this Agreement)

Users may not assign, transfer, pledge, or otherwise dispose of their position under these terms or the rights or obligations based on these terms to a third party without the prior written consent of the company.

Article 12 (Revision of this Agreement)

  1. The company may revise these terms if deemed necessary.

  2. In the event of a revision, the company shall announce the effective date and content of the revised terms on its website and social media channels or through other appropriate means. After such announcement, if a user continues to use the services, it shall be deemed that the user agrees to the revised terms.

Article 13 (Severability)

Even if any provision or part of these terms is determined to be invalid or unenforceable under the Consumer Contract Act or other laws and regulations, the remaining provisions of these terms and the remaining parts of the invalid or unenforceable provisions shall remain in full force.

Terms of Use (Online Shop)

These Terms of Use (hereinafter referred to as "the terms") set forth the terms and conditions for the use of the online shop provided by Niseko Dream Co., Ltd. (hereinafter referred to as "the company") on this website. All users (hereinafter referred to as "users") are requested to use the Services in accordance with these Terms.

Article 1 (Application)

  1. These terms shall apply to all relationships related to the use of the Services between the user and the company.

  2. The company may establish rules, etc. (hereinafter referred to as "individual provisions") other than these terms regarding the use of the services. Regardless of the name of these individual provisions, they shall constitute a part of these terms.

  3. In the event of any inconsistency between the provisions of these terms and the provisions of the individual provisions set forth in the preceding paragraph, unless otherwise specified in the individual provisions, the provisions of the individual provisions shall prevail.

Article 2 (User Registration)

  1. In the services, a person who wishes to register shall apply for registration by agreeing to these terms and following the method prescribed by the company, and registration shall be completed when the company notifies the applicant of the approval of the application.

  2. If the company determines that there is any of the following reasons for the applicant for registration, the company may not approve the application for registration without disclosing the reason:
    (1) If false information is provided at the time of applying for registration.
    (2) If the applicant has violated these terms in the past.
    (3) In any other case where the company deems the registration to be inappropriate.

Article 3 (Management of User ID and Password)

  1. The user shall be responsible for managing the user ID and password of the services at his/her own risk.

  2. The user may not transfer, lend, or share his/her user ID or password with any third party under any circumstances. If a combination of a User ID and password matches the registration information and is logged in, it will be deemed to be used by the user who has registered the User ID.

  3. Except in cases where the company has intentional or gross negligence, the company shall not be liable for any damages caused by the use of a user ID and password by a third party.

Article 4 (Sales Contract)

  1. In the services, a sales contract shall be concluded when the user applies for purchase to the company and the company notifies the user of the acceptance of the application. The ownership of the relevant product shall transfer to the user when the company delivers the product to the delivery company.

  2. The company may cancel the sales contract without prior notice to the user if any of the following reasons apply to the user:
    (1) If the user has violated these terms.
    (2) If the delivery of the product is not completed due to the unavailability of the recipient or long-term absence.
    (3) In cases where the trust relationship between the company and the user is deemed to be damaged.
    (4) Payment methods, delivery methods, cancellation methods for purchase applications, or return methods related to the services shall be determined separately by the company.

Article 5 (Intellectual Property Rights)

The copyright or other intellectual property rights of the contents, such as product photographs provided by the services (hereinafter referred to as "the contents"), belong to the company, content providers, or other legitimate rights holders, and Users may not reproduce, reprint, modify, or otherwise use the contents without permission.

Article 6 (Prohibited Acts)

Users may not engage in the following acts when using the services:

  1. Acts that violate laws or public order and morals.

  2. Acts related to criminal activities.

  3. Acts that infringe on copyrights, trademark rights, or other intellectual property rights included in the services.

  4. Acts that disrupt or interfere with the function of the company's servers or networks.

  5. Acts of using information obtained through the services for commercial purposes.

  6. Acts that may interfere with the operation of the company's services.

  7. Unauthorized access or attempted unauthorized access.

  8. Collecting or accumulating personal information of other users.

  9. Impersonating other users.

  10. Indirectly or directly providing benefits to antisocial forces related to the company's Services.

  11. Any other acts deemed inappropriate by the company.

Article 7 (Suspension of Services, etc.)

  1. If the company determines that any of the following reasons apply, the company may suspend or interrupt all or part of the services without prior notice to the user:
    (1) Maintenance, inspection, or updates of the computer system for the services.
    (2) Difficulty in providing the services due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters.
    (3) Suspension of computers or communication lines due to accidents.
    (4) In other cases where the company deems it difficult to provide the services.

  2. The company shall not be liable for any damages or losses incurred by the user or third parties due to the suspension or interruption of the services, regardless of the reason.

Article 8 (Restriction on Use and Erasure of Registration)

  1. The company may restrict or erase all or part of the use of the services, or erase the registration as a user, without prior notice to the user if any of the following applies:
    (1) Violation of any provision of these terms.
    (2) Discovery of false facts in the registration information.
    (3) Suspension of use of the user's credit card registered as a payment method.
    (4) Non-performance of payment obligations such as fees.
    (5) Failure to respond to contact from the company for a certain period of time.
    (6) No use of the services for a certain period after the last use.
    (7) Any other cases where the company deems the use of the services to be inappropriate.

  2. The company shall not be liable for any damages incurred by the user as a result of the actions taken by the company under this article.

Article 9 (Withdrawal)
The User may withdraw from the services by following the prescribed withdrawal procedure.

Article 10 (Disclaimer of Warranty and Disclaimer)

  1. The company does not guarantee that the services are free from defects (including defects in safety, reliability, accuracy, completeness, effectiveness, suitability for specific purposes, security, etc.) in fact or legally.

  2. The company shall not be liable for any damages caused to the user by the services. However, if the contract between the company and the user regarding the services (including these terms) becomes a consumer contract as defined in the consumer contract act, this disclaimer provision shall not apply. However, even in this case, the company shall not be liable for any damages caused to the user by the company's negligence (excluding gross negligence) or tort, except for special circumstances where the damage is foreseeable or foreseeable by the company or the user.

  3. The company shall not be liable for any transactions, communications, or disputes, etc. between users and other users or third parties related to the services.

Article 11 (Changes to the Services, etc.)
The company may change the content of the services or suspend or discontinue the provision of the services without notifying the user, and shall not be liable for any damages caused to the user as a result.

Article 12 (Changes to the Terms of Use)

The company may change these terms at any time without notice to the user if deemed necessary. However, if the user starts using the services after the change of the terms, the user shall be deemed to have agreed to the changed terms.

Article 13 (Handling of Personal Information)

The company shall handle personal information obtained through the use of the services appropriately in accordance with the company's Privacy Policy.

Article 14 (Notification or Contact)

Notifications or contacts between the user and the company shall be made in the manner prescribed by the company. The company shall deem the currently registered contact information to be valid and shall notify or contact the user at the registered contact information, and such notifications or contacts shall be deemed to have reached the user at the time of transmission.

Article 15 (Prohibition of Assignment of Rights and Obligations)

The user may not assign or pledge to a third party, without the prior written consent of the company, any rights or obligations under the usage agreement or these terms.
